Adverts that indicate that the vacancy is inside IR35 where the HMRC is concerned

If you are a Contractor in the UK operating via a Limited company, you will be affected by the IR35 changes in April 2020. If you are not sure what those changes are then go and do some research before continuing.

OK, you know all about IR35. Here's a list of terms that if they are in an advert will indicate that the recruiter is not interested in you operating outside IR35. Or perhaps they are not yet up to speed with the regulations.

We think that adverts for contractors that want to operate outside of IR35 will need to be radically different than the adverts that are currently being displayed.

Meanwhile, steer clear of adverts that have any of these phrases.

These snippets all appeared in vacancy adverts for Contractors. The text in italics are my comments about why the phrase should be avoided.

Immediate interview and start ASAP

As a representative of your company you have meetings not interviews.

Start Date 30/11/2019 Three months

You control the start and end dates of the project.

You will be ready to hit the ground running.

No, you won't.

Parking available.

You are not interested in the benefits that end clients offer to their permanent staff.

Start Date ASAP -Will wait notice period.

You have your own company. There is no concept of handing in your notice before you can start on another project.

Our client is urgently seeking a C# .NET Developer with 4+ years’ experience to join the team on a long-term contract basis.

You must avoid being integrated with the team at the client’s company.

Initial contract would be for 6 months which is highly likely to be extended long term.

When you quote for a project you will have considered how long it will take. There is no concept of an extension.

Possible contract extensions.

Definitely avoid any adverts that mention length of contract and extensions. Remember you will be providing a quote for a specific project and you have used your experience to calculate how long this will take to complete.

The suitable candidate will have...

You are not a candidate; you represent your company.

Competitive salary.

The word salary means indicates something closer to an employee rather than your independent software company.

Rate Up to £355 per Day.

You will be providing a fixed price quote for a specific project.

You must not supply a CV. Your company does not have a CV. It has a profile and capabilities. You also do not Apply for work. You give a fixed price quote.

With a number of positions open to join this new engineering team it's an excellent opportunity to keep yourself busy until late 2020.

You are not interested in positions. You are not interested in teams. This paragraph definitely looks like something aimed at someone who wants to be an employee.

This role will be an initial 6-month contract paying up to £500 per day.

You must avoid adverts that mentioned "role". The word 'role' is more associated with employment and permanent staff. You also already know that you are not interested in daily rates or length of contract.

This is an exciting role within a fast-paced working environment based in the heart of Bristol.

You are not interested in the working environment. You will be working from your own office.

This is an urgent hire, if you are interested please apply now.

The word 'hire' suggests something to do with employment.

6 months rolling contract.

Avoid adverts that mention a rolling contract. You need to be doing project based work for a fixed price.

If you're currently on the market looking for a brand-new change full of exciting opportunities.

You are never in the market. You are always running your company.

Summary

You should now have enough knowledge to know why you should avoid any adverts with the following phrases that indicate employment rather than a business to business relationship.
